Labor law and social security

Digital transformation, new business models and successive labor law reforms are profoundly changing both the working environment and the relations between the various stakeholders in organizations.

In the face of these major changes, a genuine labor strategy must be set up to build an effective social dialogue, adopt new management methods, engage the company in a CSR approach, and give a new dimension to the individual relationship. Now more than ever, labor law can serve as a strategic tool for enhancing your organization, legal security, talent retention and competitiveness.

Our 300 employment lawyers and HR consultants throughout France advise SMEs and multinationals alike on all aspects of labor and social security law. For complex projects or day-to-day issues, we accompany you at every stage of your business plan, from defining the strategy to implementing operational solutions, from advisory matters to litigation.

A customized, inventive and personalized approach

We favor a customized, inventive and personalized approach. Our labor law experts bring their extensive set of skills and legal tools to support the success of your projects. Our solutions are comprehensive, multidisciplinary, pragmatic and committed. To create value, we do not hesitate to draw from our firm’s complementary practice areas or add an educational component to our service via our training organization.

Our services

HR Management

To assist you with human resources management, Fidal has created a sub-practice group that includes experienced consultants and work psychologists. Focused on long-term benefits, our services range from preventing risks – including psychosocial risks, moral harassment and non-discrimination in the workplace – to advising on a wide array of HR matters: professional reorientation and coaching, caring management, QLW audit and PSR assessment, change management, team conflict resolution, social dialogue, and the implementation of ethically and socially responsible reorganization projects.

Our experience in corporate restructuring also enables us to advise companies and their executives on how to prevent social risks in the context of employment protection plans, via PSR criticality analyses and/or employability assessments. Our recognized know-how and proven methodological approach, including a mediation dimension, our knowledge of the social stakeholders and understanding of corporate-cultural specificities, guarantee you unrivalled, competitive solutions tailored to the needs of your organization and employees.

Occupational Risk Prevention and Management (OII)

Businesses are often unprepared to deal with the consequences of occupational injuries and illnesses (OII), having inadequate knowledge of all their implications. To assist you with these matters, Fidal has created a sub-practice group of specially trained lawyers well-versed in the medicolegal field, equipped with dedicated digital tools, and engaged in the day-to-day practice. They are especially recognized for their work in one-off transactions such as business acquisitions, risk assessments, negotiating and defending companies against claims relating to occupational health and safety (notably gross negligence claims).

You wish to help your teams progress in occupational risk prevention and management?

Fidal offers you Prévirisk RH by Fidal®, the first 100% full-web platform that enables you to manage your DUERP (single occupational risk assessment document) and action plan online. A truly 360-degree tool, Prévirisk RH by Fidal accompanies you at every step, from declaring the occupational injury to managing occupational illnesses, in liaison with your lawyer.

Pensions & Benefits

With the growth of corporate social responsibility, supplementary pension and benefits schemes are an increasingly strong differentiating factor in HR management and talent retention. To meet these challenges, Fidal has created a cross-practice group of multidisciplinary experts to accompany businesses and their leaders in setting up, securing and adapting their employee pension and benefits plans. We are at their side to advise and assist in the areas of company benefits, health and pension plans, welfare benefits assessments, sector-wide bargaining, executive and officer compensation… Our teams are especially recognized for their expertise in complex transactions, including restructurings, acquisitions, governance changes, insurance litigation or URSSAF reassessments.

Employee Savings & Shareholding

Employee savings and shareholding are key components of a company’s social policy. They foster the company’s performance by giving the employees and executives a stake in its profits or equity. They are also effective tools for retaining and motivating employees. To meet these objectives, the members of our dedicated sub-practice group help businesses and their leaders define, set up and optimize such schemes. They can thus assist in drafting and implementing voluntary profit-sharing plans, company savings plans (PEEs), collective retirement savings plans (PERCOs), free share plans, founder warrants (BSPCEs) and value sharing plans. With their multidisciplinary approach and recognized expertise, the members of our Employee Savings & Shareholding group deliver comprehensive and personalized advice on both day-to-day matters and one-off transactions.

Payroll

Given the complexity of labor regulations, the computerization of management software, the intensification of data crossing and the growing importance of the Nominative Social Declaration (DSN), managing payroll operations has become a vital corporate governance concern, impacting the company’s image and earnings, and carrying real financial – and even criminal – risks.

Our dedicated labor law team helps companies safeguard and optimize their payroll processes. From conducting payroll audits, ensuring statutory, regulatory and CBA compliance, representing you during URSSAF inspections to optimizing your labor costs, we provide you with customized support and innovative solutions adapted to your organization and objectives.

Employment-Related Criminal Law

Labor law is now a major source of criminal liability for companies, their legal representatives and management. To assess the risks incurred in your business operations, identify and manage risky behavior and, lastly, represent you before the prosecution authorities, Fidal has created a cross-practice group dedicated to employment-related criminal law. The group pools together the expertise of lawyers specialized in criminal litigation and employment law. This joint approach allows us to provide a comprehensive response both in preventing employment-related criminal risk and managing it over the short and/or long-term

Health & Safety

Occupational health and safety has become a central concern for businesses, representing one of the main sources of liability for legal entities, their executives and supervisory staff. Our team helps you implement your prevention policy: audit of risks and sources of infringement, delegations of authority, training of supervisory staff, preparation and updating of the DUERP (notably via our Prévirisk RH platform), adaptation of tools and documents (internal regulations, agreements, procedures, job descriptions…), safeguarding of co-activity situations and management of crisis and litigation situations (occupational injuries, harassment, asbestos). Our specialists use their legal and organizational expertise to craft practical, effective solutions that serve your company.
